Grossinator is holding the Best Audio Prank Contest called
“I’m An iPhone Grossinator”.

We are looking for a Unique, Funny, and Entertaining video based around the
Grossinator sounds.

All submissions must be submitted to YouTube and our entry form no later than
May 1st, 2009.

All submissions will be posted on the Portable Arts YouTube channel (

Users who purchased Grossinator are invited to use any of the built in features, including the delay functionality, sound looping, or the sound queue, to trick friends and catch the results on video.

The winner of the contest (as rated by visitors to the Portable Arts YouTube channel) will win a brand new portable video camera, and have their video featured as part of Grossinator’s online marketing campaign.

Contest Rules

- No copyrighted music or images other than Grossinator images may be used in your video.
- Videos must end with the display for the last 5 seconds of the video.
- Contestants must post their videos on YouTube and complete the contact form with a link to their video, in addition, receipt of contact form and link by Grossinator denotes acceptance of the Contest Terms and Conditions shown below on this page.
- The winner will be determined by the a number of factors, including the number of views and rating on their video.

Contest Terms and Conditions


1.1 Corp, with a principal place of business at 184 S. Livingston Ave.,
Suite 9-345, Livingston, NJ 07039, USA (hereinafter "Grossinator"), organize a contest
(Hereinafter “the Contest ") according to which there will be a selection of original and artistic videos
meant to be broadcast and accessible via Grossinator’s website ("Website ") at

open everyday from January 9, 2009 to May 1st, 2009 at midnight (EST).
1.3 Participation to the Contest shall imply unreserved acceptance of all of these rules (hereinafter
the “Rules”), the applicable Internet code of conduct, as well as all other applicable laws,
regulations (particularly tax) and provisions in the USA. These Rules shall therefore apply to all
entrants (hereinafter "the Entrants").


2.1 This Contest is open to any individual, throughout the World, who submit original videos that they
personally create for YouTube as described in these rules. The Contest is also open to individuals under
the age of 18 subject to prior and express parental/guardian approval. Grossinator reserves itself the right
to ask for the written justification at any time, all the more when awarding the Prize. Grossinator shall therefore
disqualify any underage entry who would be unable to show this justification within designated deadline. Such
disqualification will lead to a selection of another winner.
2.2 Are not eligible to participate, people who don’t comply with the conditions set above and
people who contributed to the Contest’s organization.


3.1 In order to participate, Entrants shall create a video no longer than 10 minutes in length, that
promotes the Grossinator application. Entrants may submit multiple entries.
3.2 All entries must be posted to YouTube and registered with Grossinator at

4.1 After May 1st 2009, a jury chosen by Grossinator will select the winning video based on YouTube popularity
and ratings.
4.2 Entrants agree and understand that it shall not be entitled to claim anything whatsoever based
on the jury’s and decision.
4.3 Any false information provided within the context of the Contest by any participant concerning identity, postal
address, telephone number, ownership of right or non- compliance with these rules or the like may result in the
immediate elimination of the participant from the Contest. Grossinator further reserves the right to disqualify any
Entry that it believes in its sole and unfettered discretion infringes upon or violates the rights of any third party or
otherwise does not comply with these official rules.


5.1 The authors of the winning video selected by the Jury will see their video broadcasted on
Grossinator's marketing efforts and on partner’s websites.
5.2 In any event, the authors of the selected videos shall not be entitled to claim the equivalent in
cash of the allocated prize nor ask for it to be changed against any other possessions or services.
5.3 In case of unavailability of the initially drawn and presented prize, Grossinator will be free to
grant the Entrant another prize which would be worth the same or its equivalent in cash.


6.1 The authors of all submitted videos grant to Grossinator a worldwide, irrevocable,
and non-exclusive right to reproduce, represent, exploit and adapt the selected videos as well as of
each of their elements in full or in part, for the purpose of the promotion of Grossinator and of
the represented artists. These rights are granted for 10 years following the date of May 1, 2009, and
do not give any right other than the granted prize.
6.2 Each Entrant warrants Grossinator that his/her video is an original creation, free of copyright
infringement and that he/she is the unique right holder of the video submitted to the Contest and its content
thereof. The Entrant notably warrants and represents that he has the right to grant such right and has
the right to enter the Rules and has the full power and authority to perform all of its obligations
6.3 Each Entrant warrants Grossinator and its Partner against any opposition, action, complaint from third
parties arising out of the use of the Video in accordance with these Rules.


7.1 Participation to the Contest implies knowledge and acceptance of the characteristics and
limitations of the Internet, particularly in terms of technical performance, response times for
consulting, checking or transferring data, interruption risks, and, more generally, any risks inherent
in any Internet connections or transmissions, the lack of protection of certain data against misuse
and the risks of contamination by viruses on the network.
7.2 It is hereby specified that Partner shall not be held liable for any direct or indirect damage
resulting from any interruption or malfunction whatsoever, from a suspension or the end of the
Contest for any reason whatsoever, or from any such direct or indirect damage as may result from
logging onto the Website in any way whatsoever. Entrants shall be responsible for taking the
appropriate measures to protect their personal data and/or software stored on their equipment
against any damage. All persons logging on to the Website and any Entrants participating to the
Contest shall do so at their own risk.
7.3 Each entrant certifies that their entry is original and that they are the sole and exclusive owner
and right holder of the submitted Entry, and that they have the right to submit the Entry in the Contest.
Each entrant agrees not to submit any Entry that (1) infringes any 3rd party proprietary, intellectual
property, industrial property, personal rights or other rights, including without limitation, copyright,
trademark, patent, trade secret or confidentiality obligation; or (2) otherwise violates applicable law in
any countries in the world. To the maximum extent permitted by law, each entrant indemnifies and
agrees to keep indemnified the Sponsor, its parent, subsidiaries, agents, directors, officers, employees,
representatives and assigns harmless at all times from and against any liability, claims, demands,
losses, damages, costs and expenses resulting from any act, default or omission of the participant
and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each
participant indemnifies and agrees to keep indemnified the Sponsor, its parent, subsidiaries, agents,
directors, officers, employees, representatives and assigns harmless at all times from and against any
liability, actions, claims, demands, losses, damages, costs and expenses for or in respect of which the
Sponsor will or may become liable by reason of or related or incidental to any act, default or omission
by a participant under these Official Rules including without limitation resulting from or in relation to
any breach, non-observance, act or omission whether negligent or otherwise, pursuant to these official
rules by a participant.
7.4 To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other
recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection
with this contest are hereby excluded, and any participant expressly waives any and all such rights.
Participants agree that these Official Rules are governed by the laws of the state of New Jersey, USA.


Grossinator reserves the right to, especially in case of force majeure, alter information on
the Website, cancel, put back, extend, shorten or modify, in all or in part, the Contest in case of
particular circumstances without having to motivate this decision and without being able to be held
responsible for it.


9.1 All the data communicated by the Entrant on the Website is only intended for Grossinator and
will remain confidential.
9.2 Gathered data may be automatically collected in order to make the jury enable to designate the
Winner of the Contest.
9.3 It is agreed that according to the law N°78-17 of January 6th, 1978 concerning computing, files
and liberties, the Entrant has a right to oppose, access, adjust and remove his personal data. In order

10.1 The present Terms of Use are subject to United States of America law.
